• Municipal Elections Recount

    Promptly following the closing of the polls on October 24, 2022, the votes cast in the recent municipal election were counted and resulted in a difference of five (5) votes for the position of mayor. On closer examination, this difference was reduced to a difference of four (4) votes.

    Based on this count of the votes the Clerk in exercise of her duty pursuant to the Municipal Elections Act, 1996 made a declaration on the day after the election that candidate Patrick Roberts was the successful candidate for mayor.

    The Clerk of the Town of Smooth Rock Falls, in exercise of her duties pursuant to the Municipal Act, 2001, and the Municipal Elections Act, 1996 provided a report regarding the vote count to Council on November 7, 2022. Council, having considered the matter, and in accordance with section 57 of the Municipal Elections Act, 1996, passed a resolution requiring a recount of the votes cast for the Mayoral position which must be done within 30 days after the Clerk’s declaration of the results of the October 24, 2022 election.

    A recount of the votes was conducted on November 9, 2022 pursuant to the Municipal Elections Act, 1996, and it was determined that there was a tie between mayoral candidate Patrick Roberts and mayoral candidate Sue Perras – 290 votes for each candidate. In accordance with section 62(3) of the Municipal Elections Act, 1996, when there is a tie, the Clerk shall choose the successful candidate by lot, which is defined in the Ontario “2022 Candidates’ Guide – Ontario municipal council and school board elections” as putting the names of the tied candidates into a hat, or other suitable container and drawing the name of the winner. Therefore, the names of both candidates were placed in a box and the Clerk drew a name at random, which was Patrick Roberts.

    Pursuant to section 62(4) of the Municipal Elections Act, 1996, the Clerk is required to declare the successful candidate on the 16th day after the recount is completed, being November 25, 2022, if no application has been made for a judicial recount.
